1. General
1.1. The website https://thinoptics.co.il (the “Website”), developed and operated by Tika International Ltd. (the “Company”), exclusive representative of ThinOptics in Israel, enables the online purchase of products displayed on the Website (the “Products”) by users in Israel and abroad.
1.2. These Terms apply to all use of the Website and any purchase made through it. They form the legal basis of your relationship with the Company. Please read them carefully before using the Website.
1.3. By browsing or purchasing through the Website, you confirm that you are legally authorized to agree to these Terms on your own behalf and on behalf of any entity you represent. If you do not agree, you are not permitted to use the Website.
1.4. Content published on the Website may also be displayed across other platforms or media, whether managed by the Company or third parties, subject to applicable law.
1.5. Words in masculine form include the feminine and plural, as applicable.
1.6. Section headings are for convenience only and do not affect interpretation.
2. Ownership of Content
2.1. Content on the Website is protected by copyright laws and international treaties and is the property of the Company or authorized third parties. All rights are reserved.
2.2. Copying, reproducing, distributing, or publishing any content without prior written consent is prohibited.
2.3. You may browse and print extracts from the Website for personal, non-commercial use only, provided that brand names and Website identifiers remain intact.
2.4. Any unauthorized use may constitute intellectual property infringement and entitle the Company to pursue legal remedies.

3. Product Purchases
3.1. The Website enables convenient and secure purchases of Products at attractive prices.
3.2. Products displayed include specifications, pricing, warranties, delivery times, and any additional details required by law. For further inquiries, contact details are provided on the Website.
3.3. Prices shown include VAT.
3.4. To complete an order, you must provide accurate personal and payment details. Providing false information may constitute a criminal offense.
3.5. Orders are confirmed upon credit card approval. If payment is not authorized, the Order will be cancelled.
3.6. Fulfillment is subject to stock availability, verification of details, and Company approval. If the Company cannot fulfill an Order, no charge will be made, and no claims may be raised against the Company.
4. Delivery
4.1. Orders above 129 NIS qualify for free courier delivery. Orders below this amount may incur a delivery fee. Self-collection is also available upon prior coordination.
4.2. Only fully paid orders will be delivered.
4.3. The Company is not liable for indirect or consequential damages due to delays or delivery failures. Liability, if any, is limited to the purchase price of the Product.
4.4. Deliveries to security-restricted areas may be delayed by up to 14 days and such delays will not be considered a breach.
4.5. For self-collection, responsibility for transportation rests with the buyer.
4.6. Shipping fees do not cover unusual or oversized deliveries.
4.7. Deliveries are subject to the terms of Israel Post or other carriers engaged by the Company. In certain areas, delivery may be made to a nearby post office or community office.
4.8. The Company may require the presence and identification of the credit card holder upon delivery.
4.9. For all purposes, the place of transaction is the registered office of the Company.

6. Eligibility to Use the Website
6.1. Purchases are permitted only by individuals over 18 who are legally competent to enter binding agreements. Minors require guardian approval.
6.2. The Company reserves the right to block or deny purchases if you:
Commit an unlawful act.
Breach these Terms.
Provide false information intentionally.
Harm the Company, the Website, or third parties.
Intend to resell or trade Products.
7. Confidentiality of User Information
7.1. Information provided by you for the purpose of purchasing Products will be used solely for order processing, subject to applicable law.
7.2. Access to personal information is restricted to authorized employees and service providers bound by confidentiality.
7.3. Credit card data is encrypted during transmission. However, internet communications may not be completely secure, and the Company cannot guarantee absolute protection.
7.4. You are responsible for maintaining the confidentiality of your login details.
7.5. The Company shall not be liable for damages caused by unauthorized access, force majeure, or third-party actions beyond its control.

8.2. By using the Website, you confirm that you have read and agreed to the Privacy Policy.
9. Order
9. Order Cancellations, Returns and Exchanges
9.1. You may cancel an Order in accordance with the Israeli Consumer Protection Law, 5741–1981, and the regulations enacted thereunder (the “Consumer Protection Law” or “Applicable Law”).
9.2. For your convenience, the principal terms relating to Order cancellations, Product returns and exchanges are set out below. In the event of any conflict between these Terms and Applicable Law, the provisions of Applicable Law shall prevail.
9.3. Notice of cancellation may be submitted to the Company by any method permitted under Applicable Law, including by email, telephone or through the online cancellation option available on the Website, using the contact details published on the Website. The cancellation notice must include the information required by law to identify the transaction and the Customer.
9.4. Cancellation Due to Defect, Non-Conformity or Other Grounds Entitling the Customer to Cancel Without Cancellation Fees
9.4.1. Where an Order is cancelled due to a defect in the Product, non-conformity between the Product and the information provided to the Customer, failure to deliver the Product by the agreed delivery date, or any other ground which, under Applicable Law, does not permit the charging of cancellation fees, the Company shall act in accordance with the Consumer Protection Law.
9.4.2. In such case, the Company shall, within the period prescribed by law, refund the amounts paid in respect of the cancelled transaction, cancel any related charge, and shall not charge the Customer any cancellation fee.
9.4.3. Where the Product has already been delivered to the Customer, its return shall be handled in accordance with Applicable Law.
9.5. Cancellation for Reasons Other Than Defect or Non-Conformity
9.5.1. Where a transaction is cancelled for reasons other than a defect in the Product, non-conformity, or any other ground entitling the Customer to cancel without cancellation fees, the Company shall, within the period prescribed by law, refund the amount paid in respect of the cancelled transaction and cancel the related charge. The Company may charge a cancellation fee not exceeding 5% of the transaction value or NIS 100, whichever is lower, all in accordance with Applicable Law.
Where the credit card company or another entity engaged by the Company for the purpose of processing credit card payments has charged the Company a fee in connection with processing the cancelled transaction, the Company may charge the Customer the amount actually charged to the Company, to the extent permitted by and in accordance with Applicable Law.
9.5.2. Where the Product has already been delivered to the Customer, the Customer shall be responsible for returning the Product to the Company and for the costs associated with such return, except where Applicable Law places responsibility for the return on the Company. The Product shall be returned in accordance with Applicable Law and in a condition that allows the Company to inspect it.
9.5.3. Opening the Product packaging or using the Product shall not, in and of itself, negate any cancellation right available to the Customer under Applicable Law. However, nothing herein shall derogate from the Company’s right to claim damages resulting from a reduction in the Product’s value due to a significant deterioration in its condition, to the extent permitted by Applicable Law.
9.5.4. A Product sent to the address provided by the Customer and refused or not collected by the Customer shall be treated as a Product returned to the Company at the Customer’s initiative, to the extent consistent with Applicable Law. Where the return of such shipment to the Company involves a cost, such cost shall be subject to the provisions of Applicable Law governing cancellation of the transaction and return of the Product.
9.6. Product Exchanges
9.6.1. A Product exchange requested by the Customer for reasons other than a defect in the Product or non-conformity between the Product and the information provided to the Customer shall be permitted in accordance with the Company’s exchange policy and subject to availability of the replacement Product.
9.6.2. Where an exchange is carried out by courier on behalf of the Company, the Customer shall be charged a shipping fee of NIS 60 (including VAT), reflecting collection of the returned Product from the Customer and delivery of the replacement Product.
9.6.3. Where there is a difference between the price of the returned Product and the price of the replacement Product, the appropriate additional charge or refund, as applicable, shall be made between the Company and the Customer in accordance with the prices applicable to the transaction and Applicable Law.
9.6.4. Nothing in the Company’s exchange policy or in this Section 9.6 shall derogate from the Customer’s right to cancel a transaction in accordance with the Consumer Protection Law or from any other right available to the Customer under Applicable Law.
9.7. Free Shipping Benefit
9.7.1. Free shipping is a benefit granted subject to the Order meeting the eligibility requirements for such benefit, as published on the Website at the time the Order is placed.
9.7.2. Where, as a result of a partial cancellation of the transaction or a Product exchange, the value of the Order falls below the amount required to qualify for free shipping, the Order shall no longer qualify for the free shipping benefit. In such case, the Company may charge the Customer the actual cost of the original shipping provided, in the amount of NIS 30 (including VAT), to the extent permitted by Applicable Law.
9.7.3. Nothing in this Section shall derogate from any rights available to the Customer under Applicable Law or permit the Company to charge any amount in excess of that permitted by Applicable Law.
9.8. Any refund following cancellation shall be made in accordance with the method and within the time periods prescribed by Applicable Law and, where possible and in accordance with Applicable Law, using the same payment method used for the original transaction.
9.9. Nothing in these cancellation provisions shall derogate from the Company’s right to claim damages resulting from a reduction in the value of the Product due to a significant deterioration in its condition, to the extent permitted by Applicable Law.
9.10. Cancellation of an Order and/or Sale by the Company
The Company may cancel an Order and/or sale, in whole or in part, including in any of the following circumstances:
9.10.1. Where a typographical, clerical or other error occurred in the details of the offer, including the price or description of the Product;
9.10.2. In the event of force majeure, war, hostilities, acts of terrorism, a state of emergency, or other circumstances beyond the Company’s reasonable control that prevent or materially interfere with fulfillment of the Order;
9.10.3. Where the Company determines that the Order or sale is connected with unlawful activity by the Customer, anyone acting on the Customer’s behalf, or a third party;
9.10.4. Where the Company has reasonable grounds to suspect that the Order was placed for resale or other commercial activity rather than for reasonable personal use, subject to Applicable Law.
9.11. Notice of cancellation of an Order by the Company shall be provided to the Customer using any of the contact details supplied by the Customer when placing the Order, including by telephone, email or written notice.
9.12. If, after an Order has been placed, a Product is found to be unavailable, the Company may, subject to Applicable Law, cancel the Order or offer the Customer an alternative Product. Where the Order is cancelled, the Customer shall receive a full refund of the amount paid for the Product or Order that was cancelled.
9.13. The Company may from time to time offer promotions, discounts and other benefits to Customers through the Website. The terms of each promotion or benefit shall be as published on the Website, and the Company may modify or discontinue them, subject to Applicable Law and the terms of the promotion as published.
10. Prescription Glasses
10.1. Orders for prescription lenses are custom-made based on details provided by you and cannot be cancelled once processed.
10.2. You are solely responsible for providing accurate prescription information. The Company is not liable for errors in prescriptions provided by the customer.
10.3. Warranty for prescription glasses applies to manufacturing defects only.
11. Warranty and Liability
11.1. The Company warrants Products as detailed on the Website.
11.2. The Company is not liable for indirect damages, loss of profit, or misuse of Products.
11.3. Liability is limited to the price of the purchased Product.
12. Miscellaneous
12.1. Use of the Website must be lawful and in accordance with these Terms.
12.2. The Company may update these Terms from time to time. Updated versions will be published on the Website and effective upon publication.
12.3. These Terms are governed by the laws of the State of Israel. Exclusive jurisdiction shall lie with the competent courts of Tel Aviv–Jaffa.
